Terms and Conditions

This document sets out the agreement between you and Beat the Q Pty Limited (ABN 34 144 912 158) (“Beat the Q” or “we/us”) for the Beat the Q Service. By registering or using Beat the Q, you agree as follows.

Introduction

    1. “Beat the Q Service” is the pre-paid facility provided by Beat the Q, which enables you to order and pay for products supplied by businesses participating in the Beat the Q program (each, a “Participating Business”), using an internet-enabled telephone, tablet, computer or other similar device.
    2. You request Beat the Q to provide you with the Beat the Q Service on the terms set out in this agreement.Payment and pricing
    3. When you first use the Beat the Q Service, you will need to set up your username and password to establish your Beat the Q Service account.
    4. Beat the Q Service is a pre-paid only service. You can add credit to your Beat the Q Service account by paying cash to a Participating Business or online using PayPal via the Beat the Q Service.
    5. If you do not use or top-up your Beat the Q Service account for 180 days or more, the credit balance in your amount in your account will expire and your balance will re-set to $0. The expiry date for each such amount can be viewed at the “My Account” section of the Beat the Q Service.
    6. Any credit amount in your Beat the Q Service account is NOT refundable.
    7. At most cafes Beat the Q is completely free. At others, there is a small transaction fee per order. Please check with your cafe for the pricing of this service and always ensure you carefully review your order for any transaction fee that may apply.
    8. To be able to place your order, you must have sufficient credit in your Beat the Q Service account for both the total order value and the applicable transaction fee.

Usage

    1. You will only use the Beat the Q Service to order and pay for products provided by Participating Businesses.
    2. Participating Businesses set the price and availability of their products, which means that Beat the Q has no control over the availability or price of the products. You are responsible for reviewing each order before paying for it.
    3. Once you have confirmed your order, you cannot change or cancel it.
    4. Further to paragraph 8 above, once the Participating Business has accepted your order, the transaction is complete and no refunds are permitted.
    5. If the Participating Business rejects your order or does not accept your order within the time required by the Beat the Q Service (your order will then timeout),the Beat the Q Service will notify you. In these instances, you will not be charged for your order or transaction.
    6. It is your responsibility to pick up your ordered products from the Participating Business when they are made available to you.
    7. Beat the Q is not responsible for the availability, dispatch or condition of any product supplied by the Participating Businesses.
    8. You cannot change your order if you change your mind or made a mistake with your order. You may deal with the Participating Business directly if you want to change your order.
    9. If you have an unauthorised order or suspect that your Beat the Q Service account has been compromised in any way, you should i) change your password at the Beat the Q website and ii) notify Beat the Q immediately.
    10. Beat the Q may suspend or terminate your access to the Beat the Q Service at any time if it suspects any misuse of the service, or if you breach these terms and conditions.

Changes in terms and conditions

    1. Beat the Q may change these terms and conditions, including the transaction fees referred to in paragraph 7,at any time. If it does, you will be asked to re accept the amended terms and conditions, including details of any new or amended fees and charges, when you next log on to the Beat the Q Service.
    2. These terms and conditions are available on the Beat the Q website at all times.

Disclaimer and liability

    1. Beat the Q is not an agent, representative or affiliate of, any Participating Business. Beat the Q provides no warranty or representation on the accuracy, completeness or correctness of any information provided by Participating Businesses or regarding the availability, quality, merchantability or the like, of the products supplied by Participating Businesses.
    2. Beat the Q makes all reasonable efforts to ensure that the Beat the Service is available to you at all times, however there may be times when the service may not be available due to technical reasons or reasons beyond its control.
    3. Beat the Q is not liable for any loss or damage incurred or suffered by anyone in connection with the access, use or misuse or the unavailability of the Beat the Q Service.
    4. This agreement is governed by the laws of New South Wales, Australia.

Privacy and communication

    1. Beat the Q collects your personal information from you (name, email, date of birth, address and mobile number) for the purpose of providing you with the Beat the Q Service. Beat the Q safeguards your personal information and does not share it anyone else unless it is permitted or required by law or you consent to it. Your name may be shared with Participating Businesses for the purpose of identifying your order at the Participating Business. If you do not provide us with the necessary information, we may not be able to provide you with the Beat the Q Service or complete your order. You can contact Beat the Q to access what personal information we hold about you.
    2. Beat the Q will send you emails and other communication informing you of changes and improvements to the Beat the Q Service and details of your Beat the Q Service account.

Refer a friend

    Once you and your friend have both met the referral conditions below, your account will be credited with one free coffee.

    1. You (‘Referrer’) must be a current Beat the Q user, to submit a referred person (‘Referral’).
    2. Only Referrals submitted via the relevant in-app form will be accepted.
    3. Your friend must sign up for a Beat the Q account. Their account must be provisioned and activated by Beat the Q, & the user must  transact with the app.
    4. Your friend must be a new customer of Beat the Q, who has not previously received any services from us. We may, at our sole discretions, deem a customer not to be a new customer in the event of similarities in name, address, phone number and/or credit card details with an existing customer.
    5. Your friend must use your unique URL when signing-up, be it online or via the app-so. No accounts will be associated to a referrer after this time.

Refer a cafe

    Once you have met the referral conditions below & the venue is signed up to Beat the Q & actively trading, your account will be credited with ten free coffees.

    1. Only Referrals submitted via the relevant in-app form will be accepted.
    2. If you’re the sole (Referrer) you are entitled to ten free coffees.
    3. If more than one person recommends the same store then you share the 10 free coffees.
    4. In the instance where there are more than ten referrers, each referrer will be entitled to one free coffee.

2 for 1 Promotion

    1. The promoter is Beat the Q PTY LTD (ABN 34 144 912 158) of Level 2, 54 Foveaux Street, Surry Hills, NSW 2010 (“Promoter”).
    2. Entry is only open to Australian residents holding a Beat the Q personal account (“Eligible Individuals”).
    3. The promotion entitles Beat the Q users to redeem a one hundred percent (100%) discount on every second hot drink placed on each Beat the Q order.
    4. The promotion is limited to cafes signed up to Beat the Q in the Sydney Region, NSW, Australia.
    5. Only available at cafes that have elected to be part of the promotion.
    6. Promotion commences at 12:01am AEST on 8/12/2014 and closes when supply runs out or at 11:59pm AEST on 12/12/2014 (“Promotional Period”) whichever occurs first.
    7. Orders placed outside of the Promotional Period are not entitled to the discount.
    8. Orders placed for products that do not fall under the category ‘Hot Drink’ will be charged at the full purchase price and are not part of the promotion.
    9. Hot drinks may vary from venue to venue.
    10. Beat the Q has no control over the menu offerings at each venue. Hot drink offerings are managed by the venues themselves.
    11. Incomplete or cancelled purchases, or purchases where payment is declined, will be deemed invalid.
    12. Maximum of four free hot drinks per order.
    13. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
    14. There is no limit to how many times an eligible individual can redeem this promotion during the promotional period.
    15. This promotion is subject to a limited supply and we, the Promoter, are not obligated to extend the promotion beyond the time frame specified.
    16. The Promoter reserves the right to end the promotion at any time, without warning or prior notice.
    17. The one hundred percent (100%) discount is not transferable, nor refundable, and must be used at the time the order is placed.
